Ohio’s House Bill 388, also known as Annie’s Law, may change the game when it comes to OVI penalties for not only first time offenders but repeat OVI offenders. Under Ohio’s current OVI law, first time offenders charged with a simple OVI face the following mandatory minimum penalties: minimum of 3 days jail that must be served consecutively or a 72 hour Driver’s Intervention Program, $375 fine, and a six (6) month license suspension, with limited driving privileges after 15 [...]
An arrest for an Operating a Vehicle Under the Influence of Alcohol (OVI) offense should not cause one to debate life or death as Hamlet did in Shakespeare's famous soliloquy; however, the decision of whether to submit to a breath alcohol test is unquestionably daunting, especially for a normal, law abiding citizen who is involved in a law enforcement investigation for the very first time.  This is certainly the most asked question that I receive from new introductions who learn of [...]
St. Patrick’s Day is just hours away. If you have plans to celebrate tonight or tomorrow, be sure to designate a sober driver or make a plan to get home safely. Troopers with the Ohio State Highway Patrol (OSHP) are urging drivers to designate a sober driver before celebrating St. Patrick’s Day. OSHP will work with local law enforcement to remove impaired drivers as part of the National Highway Safety Administration’s Buzzed Driving is Drunk Driving campaign. According to the [...]

Ohio State University’s quarterback, J.T. Barrett, is scheduled to returnto the starting lineup for Saturday's game against Illinois. On Tuesday, November 10th, Barrett was convicted of Operating a Vehicle Under the Influence of Alcohol (OVI) after being cited for OVI at a sobriety checkpoint on October 31st. Barrett was sentenced to a $400 fine, a six (6) month license suspension, and three (3) day driver intervention program. This incident brings up a couple valid questions. Are sobriety checkpoints constitutional? Could Barrett have avoided [...]
This weekend the Ohio State Highway Patrol will be joining other law enforcement officers across the country to reduce serious injury crashes and to apprehend drivers who use the interstate for criminal activity. There will be an increased number of Troopers on I-80 beginning today through the weekend. Did you know that under Ohio law, there is a mandatory administrative suspension of your driver’s license for a minimum of 90 days if you are arrested for OVI, and test above [...]

The Ohio State Highway Patrol and other law enforcement officers will be looking for impaired drivers this holiday weekend. OSHP's Drive Sober Get Pulled Over campaign begins today, Thursday, July 2nd and ends Sunday, July 5th. Drive safe this holiday weekend. If you plan on celebrating with alcohol designate a sober driver. Remember, the cost of a taxi, Uber, or Lyft is significantly less than the costs of an OVI. If you or someone you know has been arrested for OVI, we [...]
